I Took The Test And The Result Was Under The Limit; Why Did They Charge Me With DUI?

This is a common question I hear from prospective clients in Cincinnati all the time.

In Ohio, the law allows the police to charge you with DUI under ORC 4511.19(A)(1)(a) where it states that, “No person shall operate any vehicle, streetcar, or trackless trolley within this state, if, at the time of the operation, the person is under the influence of alcohol, a drug of abuse, or a combination of them.”

This does not require a chemical test results over a certain level for the state to prove their case.
