You can go to court and see if the license is in the jacket and ask for it back.

It is rare that the license is in the file though.  Typically the officer will have sent it to the BMV in Columbus along with a copy of the administrative license suspension.

The alternative is to have your attorney seek driving privileges as soon as possible.

    If this Just Happened.. and they took your license.. go back down to the driver license branch.. and just get another one! Dont say you got a DUI.. just say.. I need a Replacement License.. You Can get another.

    I wouldn’t do that. In Ohio, when you apply for a license or for a duplicate license, you have to sign an application attesting to the fact that you are not under any suspension. If you obtain a license under false pretenses or falsify an application you can be charged with a crime.

    2921.13 Falsification
    (A) No person shall knowingly make a false statement, or knowingly swear or affirm the truth of a false statement previously made, when any of the following applies:

    5) The statement is made with purpose to secure the issuance by a governmental agency of a license, permit, authorization, certificate, registration, release, or provider agreement.

    (F)(1) Whoever violates division (A)(1), (2), (3), (4), (5), (6), (7), (8), (10), (11), (13), (14), or (16) of this section is guilty of falsification, a misdemeanor of the first degree.

    Now we’ve gone from having to deal with a DUI arrest to dealing with a DUI arrest AND a subsequent falisfication charge arising out of conduct after, but related to, the DUI arrest. If this occurs in a Cincinnati DUI arrest, both charges are going to be in front of the same judge. There are ways to obtain a license or identification card – but trying to “trick” the BMV into giving it to you, is bad advice.
